I was terminated for takin care of an ill relative (In im Ma BTW) I had called in for several days to take care of an ill relative (cancer), my boss was ok with it and understood my situation. I needed to take extra time to remain caring for the relative and takin care of her daughters. My boss asked me if I could come back on day 5, I explained I could not, I needed to take care of my sister and her kids ( we lost our parents a while back and only have each other). I had never missed any time in the year I was there, was top sales person and never strayed from the handbook at all. He terminated me for personal issues. He had explained that he understood that my family was more important, and good luck with everything. How long have you been with the company? Reading you case FML (Family Medical Leave) should apply in this situation depending on if you are in fact eligible.
50 employee or more, 1250 worked hours previous year and 1 year of employment.
They needed to follow the steps in giving you a chance to deny or accept the FML. I suggest that you follow up a phone call and notify them that they did not give you any fmla, this of course if you are in fact eligible for the leave.
woudln't think you would as it was your choice to take time off and your employer can't keep your job open forever
Also you are saying that you are loking after a relative, so you are not avaialble for work, so are not actaully unemployed as such.
you should have taken a fmla it's in ur handbook...u will not get u/e benefits....
In order to get unemployment benefits, you need to be available to look for a new job. If you are still taking care of the ill relative, you are not available.
The majority of states will not let an employee have unemployment benefits in cases of excessive absenteeism. Technically when your boss asked you to come back on day 5 and you refused, you allowed the boss to terminate you for excessive absenteeism.
The law on this is not kind or fair. Unemployment laws require a person be able to work, and if you continue to be under this family obligation you just are not that available. As for the time off, as others have stated, you should have asked for FMLA when this began,
When your relative is better and you are able to go back to work, you may want to apply for unemployment just to see if you can get it. Remember this is just a group of friendly people we do not make the decisions on unemployment for your state. The ONLY way you can determine what your state's unemployment office will say is to apply. Good luck.
