My x husband, whom i dont see/ nor talk to, is in jail,in geneva ill & i was wondering how long he will be in?

DUI - 1st offense





A judge may impose:





Up to 1 year jail


Up to $1000 fine


License suspension 1 year





If he request relief from suspension of license, he must install a Breath Analyzer Ignition Interlock Device (BAIID) on his car so he will have a breathalyzer administered before being able to drive





The driving with no insurance is a separate charge and will most likely get him a fine. He will not be able to drive again until he provides proof of insurance.





The damage to property, he may be sued civilly at the owners discretion.





If convicted, he'll be sentenced , assigned a probation officer, and given probation for a specified term, normally 1 Year, during which time he will be expected to pay all fees and comply with all conditions set forth in the probation order.My x husband, whom i dont see/ nor talk to, is in jail,in geneva ill %26amp; i was wondering how long he will be in?
Well, since you didn't take his call to post bond for him (and I'm glad you didn't), then if no one else posts bond for him, he'll be there until his court appearance on the 28th. At that point, he'll probably be released with huge fines and a suspended license for the DUI. If it wasn't his first DUI or if he has lots of other traffic tickets/points, he might have been looking at 90 days in jail. If he has other criminal convictions in his background, the destruction of property could cost him some time, but probably just his time served while waiting for his court appearance.





If he doesn't plead guilty or take a plea bargain on the 28th and no one posts bail for him, he'll stay in jail until his trial.





My best guess is he'll be released the 28th with big fines due and suspended license.
