Will a judge jail someone if they are ill?

Right I know someone who is going to Court and theres a small possibity that he get convited





will a judge send him to jail as his got quite a few heath problems (NF Type 1, Scolosis, minor heart and lung problems caused by scolosis, and has a serve eating disorder and special needs)





also as this is a Family case some of the people against him don't want him to go to jail. this is the 1st time his been in trouble with the police





iam just worried about him and would like some advise

Yes, the judge can jail him. Is it likely for a first offense at age 18? Probably not unless the offense is very serious. A better question is whether a prison will take him. Most people do not know that detention centers can refuse ill prisoners. The judge might find him/herself in a quandary with the prison system. I represent a jail and we do not take prisoners who are very ill if it can be avoided. If we take a sick prisoner, we pay all the medical expenses. The judge could order a state facility to take him, but there's likely going to be a legal battle over that order.Will a judge jail someone if they are ill?
If the judge thinks your state's jail system is capable of taking care of some one in his condition, which he probably does, then they definately will send him on his way to jail.
A guy with scoliosis? that is something new to me. Not saying it doesn't happen, just every case I ever heard of was a girl.





No matter though.





In any case, there are hospitals in prisons, and medical care available.





His health will not be a get out of jail free card in and of itself.
they have most medical services in a jail. So he would most liely go. If he is very ill for a minor offense they might order house arrest.
